Permission to Use Material

Background

The Virginia Folklife Program (“VFP”) is a program of Virginia Humanities (“VH”), which is the state humanities council for Virginia and administered as a division of the University of Virginia (“University”). The VFP regularly conducts interviews, programs, and performances across Virginia and all of the recordings, images, videos, and materials from such activities are archived and preserved by VH and the Library of Virginia. VH uses these recordings to produce educational content highlighting folklife and humanities across Virginia and it makes all such content and materials available to the public through its programs, websites and its online collection (Discovery Virginia). The public is invited to view all materials collected and to incorporate or make use of any such materials in other non-commercial and educational ways that are consistent with VH’s mission, including but not limited to exhibitions, public programs, documentary films, radio broadcasts, and publications.

Use of the Materials

I understand that the VFP and VH will utilize the photograph(s) and text I provide (collectively, the “Materials”), to create educational content and archives documenting aspects of the folklife and humanities of Virginia. I understand and consent to the unlimited use, editing, reproduction, compiling, and arranging of the Materials by VFP and VH in the course of creating such content. All such editing and arranging is in the sole purview of VFP and VH and all such resultant content and archives together with the Materials shall be the sole and exclusive property of VH, including any copyrights (collectively, the “Content and Materials”). I understand that the Content and Materials shall enter VH’s online collections (including, without limitation, Discovery Virginia) and those of the Library of Virginia (LVA) and may be distributed and/or made available in any other way. I hereby consent to the use of the Materials in connection with any use by VFP and VH, including, without limitation, their use in exhibitions, public programs, documentary films, radio broadcasts, and publications in all formats and media, including on the Internet (examples may be seen here: https://www.virginiafolklife.org/sights-sounds/).

Public Use

I understand and agree that the online collections and archives of VH and the LVA are open and available to the public. I understand and agree that any portion of the Content and Materials that are placed on such databases will be viewable and downloadable by the public for free and that the public is invited to view all of the programs and materials collected and to incorporate or make use of any such materials in other non-commercial and educational ways that are consistent with VH’s mission. I hereby freely grant and share the Materials with VFP, VH, LVA and the University under the terms of the Creative Commons “Attribution-NonCommercial-ShareAlike 3.0 Unported” (https://creativecommons.org/licenses/by-nc-sa/3.0/). This means that I retain the copyright to the portion of the Materials that I have provided, but that the public may freely copy, modify, and share these items (as well as any item that they are incorporated into) for non-commercial purposes under the same terms if they include original source information and properly attribute the use. I represent that, except where I indicate otherwise, I, to the best of my knowledge, hold the copyright or other proprietary right in the Provided Material (defined below) or that the Provided Material is in the public domain, and that I have authority to grant this permission. I hereby grant to VFP, VH, LVA and the University and all persons or entities acting pursuant to their authority a non-exclusive, royalty-free license in perpetuity to make any materials I provide or present in the course of my participation in the interview (e.g., personal documents, biographical information, photographs, and/or videos) (hereinafter collectively referred to as the “Provided Material”) available on a free and open basis to the public, including the right to use, reproduce, exhibit, publish, edit, and distribute the Provided Material as part of the Content and Materials in exhibitions, public programs, documentary films, radio broadcasts, and publications in all formats and media, including on the Internet.

Required Disclosures

I further understand and consent to the disclosure by VH and the University of the Content and Materials and Provided Material that the University may be required to disclose under University policy or by law, including pursuant to the Virginia Public Records Act.
